    Determining compensation for the adoption of the development plan should always take into account the use of the plot in the old plan, even if it?s already ineffective.

    On 20 January 2016. Court of Appeal in Katowice issued and favorable verdict for our law firm clients in case connected with compensation for loss of property value due to adoption of the zoning plan. The case concerned the situation when there was some kind of planning gap- when old zoning plan was expired, while new plan occurred after several years.

    Inviting foreigners by Polish businessman

    More and more often the main reason why the foreigners to come to Poland are business purposes. Polish companies often invite their foreign partners to Poland in order to organize meetings or various training courses for employees of their foreign branches or for their foreign partner companies. Foreigners who plan to come to Poland often want to get an official invitation from their partners - Polish entrepreneurs. The invitation is a major facilitation for people applying for a visa. The registered invitation can be used as a document confirming that the foreigner have sufficient financial means to cover the costs connected with the stay in Poland, including the costs of accommodation and board, the costs of return to the country of origin or residence or the costs of transit to a third country, which provides leave to enter.

    Purchase of property and the height of PCC

    In accordance with the provisions of the Act on the civil law transactions tax, in the case of a property sale the transaction is taxed 2% tax on civil law transactions. Receivable of tax authorities is paid by the buyer on the day of contract of sale transferring the ownership. The tax amount depends on the market value of the property.

    Reconciliation of the draft zoning

    Regional Administrative Court in Warsaw following a complaint by the law firm Duraj & Reck and Partners in Katowice overruled the decision of the Minister of Health refusing to agree on the draft zoning of real estate located in the protection zone of spa, to which customer was planning to development.

    Firm defends the interests of farmers – Ombudsman responds and notes issue

    Duraj & Reck and Partners Law Office has applied to the Ombudsman to examine the constitutionality of the provisions on EU subsidies to farmers. By the Act on payments in the framework of direct support system, the Polish parliament introduced the solution in which area payments to farmers in excess of EUR 150 thousand Euro will be reduced by 100%.

    Two positive decisions of the Office of Competition and Consumer Protection

    On request of Duraj & Reck and Partners, Office of Competition and Consumer Protection issued two decisions unconditionally allowing for the concentration of companies. Antitrust proceedings were related to the consent to the acquisition of control of companies by their sales. As a result, the road was opened for signing of final contracts for the sale of the merging parties.
