Regional Administrative Court in Warsaw following a complaint by the law firm Duraj & Reck and Partners in Katowice overruled the decision of the Minister of Health refusing to agree on the draft zoning of real estate located in the protection zone of spa, to which customer was planning to development.

According to art. 60 of the Act of 27 March 2003 on Spatial Planning and Development zoning permit may be realeased upon obtaining the authority necessary arrangements. These proceedings are ancillary and is part of the procedure in the matter of issue zoning. The important factor is that the result is binding on the authority conducting the main proceedings. In conclusion allow the action will enable our client to realize planned investment.
