Universal insurance for notaries: pensions and death
In the notarial self-government, an obligatory contribution for universal insurance: disability and death insurance was introduced in the “REJENT-LIFE” Insurance Company with its registered office in Poznań. In the opinion of Duraj Reck & Partners, this is tantamount to accepting an obligation of life insurance unknown to the law.
The Law Firm represents the client, a member of the notarial self-government, in actions aimed at removing the obligation to insure notaries. The first step that was taken in this direction was to submit a request to the Minister of Justice to undertake supervisory activities provided for by the Law. In this respect, the Law Firm is of the opinion that the imposition of the obligation of insurance by the bodies of the notarial self-government took place outside the limits of the statutory authorization, and thus cannot constitute a valid basis for the obligation on the part of the notary, who is not interested in concluding such an agreement.
The initiated actions may be an impulse for a serious change in the rules of calculating contributions by notarial self-government bodies, with effect for the entire notary’s office.
